The Muslim Personal Law is supposed to protect Women from discriminatory customary laws, but is very ineffective. Why does religion decide come over Law?

Several laws have been enacted to address the concerns of Muslim women in India dealing primarily with issues like marriage, divorce, maintenance and inheritance. But at the community or societal level, these laws do not help them much in seeking justice. The laws that are framed exclusively for Muslim women fail to protect their rights and prove ineffective in helping them enjoy the status as guaranteed to them in the Quran. In the absence of a codified personal law, Muslim women in India are still subjected to gender injustice and inequalities.

The Shariat Application Act, 1937

In 1937, Muslim Personal Law (Shariat) Application Act was passed when India was still a British colony. Its main objective was to govern the Muslim community by a unified shariat law and not by the prevailing customary laws that have displaced the rules of the shariat law.

Beginning of the end of the secular Indian state. ‪Muslim majority areas are a becoming a problem for non-Mulsims and hence repercussions are creating a disastrous loop

in a state with many religions, were in there is one religion with majority, it tries to achieve its dominance in running the matters related with the government and this culture is not to be conducive in the long run, implying, the state to not interfere in the religious matters and also not to get influenced by any religion irrespective of its strength. State, when it pursue the provision of secular in its country should strive to maintain that and it is observed only when, state doesnot mix both the religion and state, and provides for equal space for all religions to pursue their practices. This nurtures the society in the right direction and instills a sense of confidence. It is observed that, if there is no opportunity for one to change his religion as per his needs, then there exists a condition of stagnation, were in, no opportunities provided by the state for individual freedom, so therefore freedom towards these have benefit ted the nation in the long run. For eg: this gave opportunity to abolish discrimination, untouchability etc.
