Are we on the brink of a constitutional crisis ?


Karnataka assembly passed a resolution stating they refuse to implement the Supreme Court’s September 20 order to release water at the rate of 6,000 cusecs to Tamil Nadu.

How come this is not contempt of court? Will SC back down to avoid further escalation and more importantly what message does this act sends ?

Our constitution provides for the judicial review provision where in courts can overlook the govt policies and actions and seek explanations, provide opinions and also strike down certain laws wherever it is not in the public interest or if it is ultra vires and violates the constitutions. But this provision has also lead to supreme court intervening actively in the policy formulation, some of these judgments like SC striking down section 66A of IT act for violation of fundamental right to freedom of speech, SC questioning govt on the policy implementations like that of clean ganga or SIT formation for black money

Task of Judiciary is not to formulate policy but failure of good governance has forced judiciary to widen its limited role in democratic practices of the nation. It is not to be proud of that Supreme Court intervenes in policy decisions, it matter of shame for government of union and states that they don’t adhere to constitutional standards. Its shame for civilians who are responsible for electing lawmakers who had often mocked due process established by law.

This issue has one thing in common and that is crops, both the government should try not to grow more water consuming crops in the area where scarcity of water is there. ( Karnataka should look for sugarcane and T.N for paddy ). Both the states should look for the source of the issue i.e the monsoon, as since decades the Deccan monsoon varies and is not constant and this is because of the management of trees in Western Ghats and its slash and burn farming techniques.
